Executive Summary: |
The property at 1100 E. 23rd Street is being platted as the first step in the redevelopment of the Heritage Tractor Dealership. The Heritage Tractor Final Plat will create one lot of approximately 4.02 acres.
The preliminary plat was accepted by the Planning Commission at their November 14, 2018 meeting. The final plat varies from the preliminary plat in two matters:
1) A 15 foot wide utility easement proposed along the east side of the property for the extension of a waterline has been replaced with a 15 foot wide utility easement along the west side of the property. The applicant had been unable to obtain the easement from the property owner to the east to extend the water main to the property so the western utility easement will allow a looped water system to be developed on the property without extension of the main to the east.
2) The Land Development Code requires 75 feet of right-of-way on the subject side of the road centerline for principal arterials, such as E. 23rd Street. This right-of-way was shown on the approved preliminary plat. The County Surveyor since has discovered a KDOT condemnation case (Case No. 15946) which alters the right-of-way slightly. The right-of-way has been slightly extended where the right-of-way acquired by the condemnation case exceed the 75 feet.
