Recommendations/Options/Action Requested:

Authorize City Manager to sign an agreement with TSP Environmental in an amount of $1,235,158.00 for Bowersock Dam Scour Hole Repairs (CIP #UT1885) and Kansas Riverbank Stabilization (CIP #PW17E9) and engineering design of additional recreational features.

Executive Summary:

On October 2, 2018, the City Commission approved using an alternative delivery method to receive Request for Proposals (RFP’s) for the Bowersock Dam Scour Hole Repairs and Kansas Riverbank Stabilization project. The RFP called for proposals to include additional recreation improvements, including an engineered rapids feature and improvements that would enhance public access to the river. The recreation features were not contemplated in the Capital Improvement Program but are eligible for potential funding by the Kansas Department of Wildlife, Parks and Tourism (KDWPT). City staff met with the KDWPT and Kansas State Fisheries regarding potential intergovernmental funding for certain aspects of the project. KDWPT’s interest is expressed in the attached letter.

 

On November 6, 2018, three proposals were received from Barcus Construction, Kissick Construction, and TSP Environmental. The staff selection committee conducted interviews with each vendor December 4, 2018 and December 7, 2018 and recommends awarding the contract to TSP Environmental for the following reasons: The proposal submitted by TSP was the most thorough, addressed all project components, the project team demonstrated successful completion of several similar projects, reasonable schedule, good project understanding and competitive pricing.

 

The recommended contract with TSP includes costs of $573,596 for scour hole repairs at the dam and $599,562 for riverbank stabilization work. An additional $62,000 in engineering costs are included for the potential recreational facilities and river access improvements.

 

Construction of the recreation features will be presented to the City Commission as a future decision. Upon completion of plans, agency approvals (i.e. Corps of Engineers, Division Water Resources and Federal Energy Regulatory Commission), commitment of funding from KDWPT and determination of costs for the improvements, staff will negotiate a change order with TSP for construction of the recreation facilities. Staff will present that change order for the Commission’s consideration to authorize the construction of the recreational features as part of the maintenance project.

 

Staff met with representatives of Riverfront LLC, Marriott, Abe & Jake’s Landing and Bowersock Mill to review the project and discuss the impact of construction as well as potential public access needs should a recreation facility be constructed. All parties expressed interest in accommodating public access needs should the recreation facilities be constructed, but formal agreements with property owners and tenants may be necessary.

The fiscal impact to the City is $1,235,158.00. This cost includes design of the recreation features but not construction. Construction costs for the recreation features will be presented in a future change order. Any potential intergovernmental funding agreements would be presented in coordination with the change order. The project(s) are funded by the 2018 Budget and CIP. A budget summary follow:
