Recommendations/Options/Action Requested:

Adopt on first reading, Ordinance No. 9610, authorizing the City Manager to administratively determine the dates and times for the prohibition of glass bottles and containers and the prohibition of rooftop access at specified periods during the NCAA Men’s Basketball Tournament, if appropriate.  

Executive Summary:

Each year around the time of the Final Four, staff presents an ordinance to the Commission for approval regarding the prohibition of glass bottles and containers downtown during specified dates and times. Additionally, issues regarding rooftop access and the closure of certain streets to accommodate large crowds is also discussed. Staff makes its recommendations to encourage safe and efficient celebrations. An ordinance related to glass bottles and containers has been presented to the Commission each year for the last five years. Examples of the glass bottles and container ordinances most recently adopted are attached.

 

In the interest of efficiency, the attached ordinance provides the City Manager with authority to determine the dates and times for when glass bottles and containers will be prohibited and when accessing rooftops will be prohibited. The ordinance specifies that any such rules established by the City Manager are reserved only during the KU men’s basketball team’s participation in the NCAA Men’s Basketball Tournament. This ordinance would allow the dates/times to be set administratively rather than presenting an ordinance each year to the Commission.

 

This ordinance helps address safety concerns and reminds citizens of the importance of being vigilant during this highly anticipated event. The Police Department has previously successfully managed extremely large crowds, and this ordinance would assist in continuing to improve that management.
