ORDINANCE NO. 9623

 

AN ORDINANCE OF THE CITY OF LAWRENCE, KANSAS, REZONING APPROXIMATELY .91 ACRES FROM CS (STRIP COMMERCIAL) DITRICT TO CD-PD (DOWNTOWN COMMERCIAL – PLANNED DEVELOPMENT OVERLAY) DISTRICT AND AMENDING THE CITY’S “OFFICIAL ZONING DISTRICT MAP,” INCORPORATED BY REFERENCE INTO THE CITY CODE AT CHAPTER 20, ARTICLE 1, SECTION 20-108 OF THE CODE OF THE CITY OF LAWRENCE, KANSAS, 2018 EDITION, AND AMENDMENTS THERETO.

 

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS:

 

SECTION 1. The base zoning district classification for the following legally described real property, located in the City of Lawrence, Douglas County, Kansas, to-wit:

 

A tract of land in Section 30, Township 12 South, Range 20 East and that part of Bridge Street, Lot 41, 43, 45, 47 & 49 and that part of Block 2 North Lawrence, Lots 55, 57, 59, 61 & 63 all in the city of Lawrence, Douglas County, Kansas being more particularly described as follows:

 

Commencing at the Southwest corner of said Lot 41, North Lawrence; thence N01°38'22"W, along the West line of said Lot 41, a distance of 2.00 feet to the point of beginning of herein described tract; thence S88°21'38"W, a distance of 30.00 feet; thence N01°38'22"W, a distance of 143.00 feet to a point of intersection with the centerline of Locust Street and the centerline of Massachusetts Street as it now exists; thence S88°21'38"W, along said centerline of Locust Street, a distance of 30.00 feet to a point on the West Right of Way line of Massachusetts Street as it now exists; thence N01°38'23"W, along said West Right of Way line, a distance of 144.29 feet; thence N88°21'38"E, a distance of 155.00 feet to a point on the West Right of Way line of N 2nd Street as it now exists; thence S01°38'22"E, along said West Right of Way line, a distance 114.29 feet to a point of intersection with the North Right of Way line of Locust Street and said West Right of Way line as it now exists, also known to be the Southeast corner of Lot 55, North Lawrence Addition Number 2; thence S03°31'37"E, a distance of 50.03 feet to a point of intersection with the West Right of Way line of N 2nd Street and the South Right of Way line of Locust Street as it now exists; thence along said West Right of Way line Southeasterly on a curve to the right having a radius of 1670.46 feet, a chord bearing of S06°26'18"W, a chord distance of 106.57 feet and an arc distance of 106.59 feet; thence S08°15'58"W, continuing along said West Right of Way line a distance of 17.75 feet; thence S88°21'38"W, a distance of 78.62 feet to the point of beginning.

 

39,465.58 square feet more or less or 0.91 acres

 

is hereby changed from CS (Strip Commercial) District to CD-PD (Downtown Commercial – Planned Development Overlay) District, as such district is defined in Chapter 20 of the Code of the City of Lawrence, Kansas, 2018 Edition, and amendments thereto.

 

SECTION 2. The “Official Zoning District Map,” which is adopted and incorporated into the City Code by reference at City of Lawrence, Kan., Code § 20-108 (Jan. 1, 2018), is hereby amended by showing and reflecting thereon the new zoning district classification for the subject property as described in more detail in Section 1, supra.

 

SECTION 3. If any section, sentence, clause, or phrase of this ordinance is found to be unconstitutional or is otherwise held invalid by any court of competent jurisdiction, it shall not affect the validity of any remaining parts of this ordinance. 

 

SECTION 4. This ordinance shall be in full force and effect from and after its passage and publication as provided by law.
