ORDINANCE NO. 9622

 

AN ORDINANCE OF THE CITY OF LAWRENCE, KANSAS, REZONING APPROXIMATELY 5.03 ACRES FROM OS (OPEN SPACE) DISTRICT TO CD-PD (DOWNTOWN COMMERCIAL – PLANNED DEVELOPMENT OVERLAY) DISTRICT AND AMENDING THE CITY’S “OFFICIAL ZONING DISTRICT MAP,” INCORPORATED BY REFERENCE INTO THE CITY CODE AT CHAPTER 20, ARTICLE 1, SECTION 20-108 OF THE CODE OF THE CITY OF LAWRENCE, KANSAS, 2018 EDITION, AND AMENDMENTS THERETO.

 

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS:

 

SECTION 1. The base zoning district classification for the following legally described real property, located in the City of Lawrence, Douglas County, Kansas, to-wit:

 

A tract of land in Section 30, Township 12 South, Range 20 East and that part of Block 14 Massachusetts Street, Lots 27 & 29 and that part of Block 1 Bridge Street, Lots 31, 33, 35, 37, 39 & 41 and that part of Block 1 Massachusetts Street, Lot 33, 37, 41, 45 & 49 and that part of Block 1 Elm Street, Lot 58 and that part of Locust Street, Lots 46, 50, 53, 54, 57 & 58 and that part of Block 1 Maple Street, Lot 45 and that part of Maple Street, Lot 45, 49, 53 & 57 and that part of North Lawrence Addition Number 2, Lot 98, 99, 100 & 101 all in the city of Lawrence, Douglas County, Kansas being more particularly described as follows:

Beginning at the Southeast corner of Lot 36, North Lawrence Addition Number 2; thence S48°03'11"W, a distance of 93.82 feet to a point on the East Right of Way line of Levee as it now exists; thence N06°14'46"E, along said East Right of Way line, a distance of 362.74 feet; thence continuing along said East Right of Way line Northeasterly on a curve to the right having a radius of 700.00 feet, with a chord bearing of N10°21'38"E, a chord distance of 100.07 and an arc distance of 100.15 feet; thence S01°46'51"E, a distance of 396.50 feet to the point of beginning.

 

15,635.72 square feet more or less or 0.36 acres

 

is hereby changed from OS (Open Space) District to CD-PD (Downtown Commercial – Planned Development Overlay) District, as such district is defined in Chapter 20 of the Code of the City of Lawrence, Kansas, 2018 Edition, and amendments thereto.

 

SECTION 2. The “Official Zoning District Map,” which is adopted and incorporated into the City Code by reference at City of Lawrence, Kan., Code § 20-108 (Jan. 1, 2018), is hereby amended by showing and reflecting thereon the new zoning district classification for the subject property as described in more detail in Section 1, supra.

 

SECTION 3. If any section, sentence, clause, or phrase of this ordinance is found to be unconstitutional or is otherwise held invalid by any court of competent jurisdiction, it shall not affect the validity of any remaining parts of this ordinance. 

 

SECTION 4. This ordinance shall be in full force and effect from and after its passage and publication as provided by law.
