Recommendations/Options/Action Requested:
Authorize the City Manager to execute Supplemental Agreement No. 1 to the Engineering Services Agreement with GHD, Inc., for the Farmland Remediation Project, in the amount of $143,738.
Executive Summary:		Since approval of the original contract with GHD on April 3, 2018, the City has been pursuing changes to the long-term environmental remediation project at the former Farmland Nitrogen Fertilizer Plant. Phase one of this effort includes professional services related to site study, analysis of alternative remediation strategies and regulatory approvals for alternative strategies prepared by the selected firm, GHD. The project scope, as proposed by GHD in 2018, includes data review, existing remediation systems evaluation, remediation alternative evaluation and recommendation, and community engagement. Staff and GHD have worked continuously to produce a remediation alternative that may be presented to the Kansas Department of Health and Environment (KDHE). The first step in the approved contract with GHD included site data review and development of an updated conceptual site model. During their development of the static 3D model and detailed review of current systems and monitoring data, GHD and the City have identified data gaps and changes to the site conditions, which prevent the completion of the original scope of work as requested. To address these data gaps, the City Staff and GHD prepared a data gap study work plan that was presented to KDHE on November 21, 2018. On January 23, 2019 the City received correspondence indicating that the data gap study work plan had been approved by KDHE (attached).  Until the data gap study has been performed, an alternative analysis and recommendation of remedial alternatives cannot be reasonably completed and presented to KDHE for review and approval. In addition to the work associated with the approved work plan, GHD added a task to this supplemental agreement that includes a list of additional tasks performed during the execution of the specific authorized services, which were either underestimated in terms of anticipated labor or time required to complete them. Included in this section are services GHD provided (or have been requested to provide) which were not originally anticipated by the City or GHD or are not part of the Data Gap Study Work Plan The approximate schedule for the work included in the data gap study, as stated in the work plan approved by KDHE, is below: GHD anticipates completing the field work within 30 days of the City’s notice to proceed after commission approval of Supplemental Agreement No. 1. Laboratory analyses is expected to be completed within 2 weeks from sample collection. Upon receipt of all the data from this effort, GHD anticipates providing a data gap study report within 60 days after completion of the field and laboratory work.

Fiscal Impact (Amount/Source):		Awarding the change as recommended will have a fiscal impact to the City of $143,738.  Funding for this project comes from the 2019 Farmland Remediation Trust Fund account no. 604-3-3400.
