Moore, to vacate a platted reserved right to locate, construct and maintain pipes for sewerage purposes across 1513 Crescent Road, executing the Kansas Bill of Sale for the new service lateral to the property owner and approving the Order of Vacation. |

Executive Summary: |
The proposed vacation is for a reserved right described in the Original University Heights Part Two Plat, to locate, construct and maintain pipes for sewerage purposes across Lot 16, also known as 1513 Crescent Road. There is no defined easement or legal description for the proposed vacation.
As part of the 2017 Naismith Drive and Crescent Road Street, Sidewalk, Storm and Sanitary Sewer Improvement Project, a public sanitary sewer crossing 1513 Crescent Road was abandoned. A new public sanitary sewer was constructed in Crescent Road going west in order to continue sewer service to the properties upstream of this location. A new private service lateral on 1513 Crescent Road was constructed to connect that property to the existing public sewer to the south. Since the new sewers was constructed, the City no longer needs to reserve the right to maintain a public sanitary sewer crossing 1513 Crescent Road.
All utilities as well as property owners within 200 feet were notified and no objections were received.
Staff recommends executing the Kansas Bill of Sale to transfer ownership of the new service lateral to the property owner and approving the Order of Vacation.
