ORDINANCE NO. 9620

 

AN ORDINANCE OF THE CITY OF LAWRENCE, KANSAS, REZONING APPROXIMATELY 0.18 ACRES FROM PCD-[PINE RIDGE PLAZA]  (PLANNED COMMERCIAL DEVELOPMENT) DISTRICT TO CS (COMMERCIAL STRIP) DISTRICT AND AMENDING THE CITY’S “OFFICIAL ZONING DISTRICT MAP,” INCORPORATED BY REFERENCE INTO THE CITY CODE AT CHAPTER 20, ARTICLE 1, SECTION 20-108 OF THE CODE OF THE CITY OF LAWRENCE, KANSAS, 2018 EDITION, AND AMENDMENTS THERETO.

 

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS:

 

SECTION 1. The base zoning district classification for the following legally described real property, located in the City of Lawrence, Douglas County, Kansas, to-wit:

 

COMMENCING AT THE NORTHWEST CORNER OF LOT 1A, PINE RIDGE PLAZA ADDITION, A SUBDIVISION IN THE CITY OF LAWRENCE, DOUGLAS COUNTY, KANSAS; THENCE SOUTH 02 DEGREES, 16 MINUTES, 55 SECONDS EAST ALONG THE WEST LINE OF SAID LOT 1A, A DISTANCE OF 121.15 FEET TO THE CENTERLINE OF A DRAINAGE EASEMENT AS PLATTED, ALSO BEING THE NORTHWEST CORNER OF LOT 1B OF A LOT SPLIT OF LOT 1, PINE RIDGE PLAZA ADDITION, RECORDED IN PLAT BOOK 18, PAGE 19, DOUGLAS COUNTY, KANSAS REGISTER OF DEEDS, AND ALSO BEING THE POINT OF BEGINNING; THENCE SOUTH 60 DEGREES 33 MINUTES 52 SECONDS EAST ALONG THE NORTH LINE OF SAID LOT 1B, A DISTANCE OF 281.09 FEET TO A POINT ON THE WESTERLY RIGHT OF WAY LINE OF OUSDAHL ROAD, SAID POINT ALSO BEING THE NORTHEAST CORNER OF SAID LOT 1B; THENCE SOUTH 02 DEGREES, 17 MINUTES, 29 SECONDS EAST ALONG SAID WESTERLY RIGHT OF WAY LINE AND THE EAST LINE OF SAID LOT 1B, A DISTANCE OF 25.95 FEET; THENCE SOUTH 87 DEGREES 41 MINUTES, 50 SECONDS WEST, A DISTANCE OF 15.08 FEET; THENCE NORTH 60 DEGREES, 33 MINUTES, 52 SECONDS WEST, A DISTANCE OF 263.37 FEET TO A POINT ON THE WEST LINE OF SAID LOT 1 B; THENCE NORTH 02 DEGREES, 16 MINUTES, 55 SECONDS WEST ALONG SAID WEST LINE, A DISTANCE OF 35.27 FEET TO THE POINT OF BEGINNING, CONTAINING 8,362 SQUARE FEET OR 0.192 ACRES.  

 

is hereby changed from PCD-[Pine Ridge Plaza] (Planned Commercial Development) District to CS (Commercial Strip) District, as such district is defined in Chapter 20 of the Code of the City of Lawrence, Kansas, 2018 Edition, and amendments thereto.

 

SECTION 2. The “Official Zoning District Map,” which is adopted and incorporated into the City Code by reference at City of Lawrence, Kan., Code § 20-108 (Jan. 1, 2018), is hereby amended by showing and reflecting thereon the new zoning district classification for the subject property as described in more detail in Section 1, supra.

 

SECTION 3. If any section, sentence, clause, or phrase of this ordinance is found to be unconstitutional or is otherwise held invalid by any court of competent jurisdiction, it shall not affect the validity of any remaining parts of this ordinance. 

 

SECTION 4. This ordinance shall be in full force and effect from and after its passage and publication as provided by law.
