RESOLUTION NO. 7280

 

A RESOLUTION AUTHORIZING VARIOUS PUBLIC IMPROVEMENTS AND THE ISSUANCE OF GENERAL OBLIGATION BONDS AND/OR TEMPORARY NOTES TO FINANCE ALL OR A PORTION OF THE COSTS OF CERTAIN IMPROVEMENTS.

 

            WHEREAS, the City of Lawrence, Kansas (the “City”) is a city of the first class, duly created, organized and existing under the Constitution and laws of the State; and

 

            WHEREAS, pursuant to Ordinance No. 9274, the City has previously approved the 2017-2021 Capital Improvement Plan (the “2017-2021 CIP”); and

 

            WHEREAS, pursuant to Ordinance No. 9387, the City has previously approved the 2018-2022 Capital Improvement Plan (the “2018-2022 CIP”); and

 

            WHEREAS, pursuant to Ordinance No. 9554, the City has previously approved the 2019-2023 Capital Improvement Plan (the “2019-2023 CIP”); and

 

            WHEREAS, Charter Ordinance No. 46 was previously approved by the City and pursuant to Article 12, Section 5 of the Constitution of the State of Kansas (the “Home Rule Amendment”), and such Charter Ordinance authorizes the governing body of the City to make the following improvements and to issue its general obligation bonds and/or temporary notes to finance the costs of a variety of public improvements as further described therein; and

 

            WHEREAS, Charter Ordinance No. 40 was previously approved by the City and pursuant to the Home Rule Amendment, and such Charter Ordinance authorizes the governing body of the City to make the following improvements and issue its general obligation bonds and/or temporary notes to finance the a variety of public improvements as further described therein; and

 

WHEREAS, Charter Ordinance No. 28 was previously approved by the City and pursuant to the Home Rule Amendment, and such Charter Ordinance authorizes the governing body of the City to make improvements to storm sewer systems and all appurtenances necessary to the maintenance and operation of storm sewer systems, including alley improvements associated with such storm sewer systems, and to issue general obligation bonds and/or temporary notes of the City to finance the costs of such improvements;

 

WHEREAS, pursuant to K.S.A. 12-685 et seq., the governing body of the City has previously authorized the improvement of certain main trafficways or trafficway connections designated and established under the provisions of K.S.A. 12-685 et seq., and further authorized the issuance of general obligation bonds and/or temporary notes to finance the costs thereof; and

 

WHEREAS, pursuant to Article 12, Section 5 of the Constitution of the State of Kansas (the “Home Rule Amendment”), the City has previously approved the making of a grant to the Lawrence Humane Society, Inc., in order to enhance and provide for public health, safety and welfare of the City and its citizens, and has authorized the issuance of general obligation bonds and/or temporary notes to finance the costs thereof; and

 

            WHEREAS, the City now seeks to authorize certain improvements and the issuance of general obligation bonds or notes to finance the costs of such improvements previously included in the 2017-2021 CIP, the 2018-2022 CIP and/or the 2019-2023 CIP, all as set forth in Exhibit A attached hereto.

 

            NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS, AS FOLLOWS:

 

            Section 1.         Approval of the Projects.  The governing body of the City hereby authorizes and orders the construction of the improvements described in Exhibit A attached hereto, or ratifies the prior authorization to construct improvements described in Exhibit A that have previously been authorized by ordinance or resolution of the governing body

 

Section 2.         Issuance of General Obligation Bonds and/or Temporary Notes.  Pursuant to K.S.A. 12-685 et seq., the Home Rule Amendment, Charter Ordinance No. 28, Charter Ordinance No. 40 and Charter Ordinance No. 46, the governing body of the City hereby authorizes (or ratifies prior authorization of) the issuance of general obligation bonds and/or general obligation temporary notes to fund the improvements authorized in Section 1 of this Resolution.  Such general obligation bonds and/or general obligation temporary notes may be issued in the maximum principal amounts set forth in Exhibit A attached hereto.  The City expects to make expenditures prior to the issuance of such general obligation bonds and/or general obligation temporary notes, and any such tax-exempt general obligation bonds and/or general obligation temporary notes issued under the authority of this Resolution may be used to reimburse expenditures made on or after the date that is 60 days before the date of passage of this Resolution pursuant to U.S. Treasury Regulation §1.150-2. 

 

Section 3.         Further Authority.  The Mayor, City Clerk, and Finance Director and other appropriate officers and agents of the City are hereby authorized and directed to take such action, expend such funds and execute such documents, certificates and instruments as may be necessary or desirable to carry out and comply with the intent of this Resolution.

 

            Section 4.         Effective Date.  This Resolution shall take effect and be of force from and after its passage by the governing body of the City and approval by the Mayor.

Project Description:  General obligation debt of the City will be issued to make a grant to the Lawrence Humane Society, Inc., in the amount not to exceed $2,500,000 for use in connection with the acquisition, construction and equipping of a facility to be located in the City and owned and occupied by the Humane Society in order to better provide the City with animal control and services related thereto.

Project Description:  The repair, reconstruction and replacement of the pavement located at the following Fire Stations and making any necessary and related improvements thereto.

Summary of Changes:  Resolution No. 7273 gave authorization to make improvements to Fire Station No. 5 in an amount not to exceed $368,820.18 plus issuance costs and interest. This was completed ahead of the other projects because other work is occurring in the area that would help minimize costs. The increased authorization is to incorporate the remainder of the locations included in the project scope.

Project Description:  Design, repair, renovate and reconstruct Fire Station No. 1 of the City, including various interior and exterior improvements necessary to address the operational needs of the City’s fire and medical departments, renovations necessary for ADA compliance and other related and appurtenant improvements.

 

Summary of Changes:  Resolution No. 7192 gave authorization to make improvements to Fire Station No. 1/Senior Resource Center in an amount not to exceed $6,287,000 plus issuance costs and interest. The increased authorization figure aligns with current project estimates.

Project Description:  Replacement of existing Fire Training Tower located at 1941 Haskell Avenue and design and construction of a new Fire Training Tower.

 

Summary of Changes: Resolution No. 7243 gave authorization to make improvements to the Fire Training Tower in an amount not to exceed $700,000 plus issuance costs and interest. The increased authorization aligns with current project estimates that were increased due to significant site plan improvements that were required to be completed as part of the project.

Project Description:  The design, planning, construction, equipping and furnishing a new police department facility located at 5100 Overland Drive.  Project shall include an amount up to $340,000 to fund public art located at the facility.

 

Summary of Changes: Resolution No. 7222 gave authorization to design and construct a new police facility in an amount not to exceed $18,500,000 plus issuance costs and interest. The increased authorization is to include funds for public art that was included in the CIP but not in the initial authorization.

Summary of Changes: Resolution No. 7254 gave authorization to make improvements to a number of locations across the City in an amount not to exceed $500,000 plus issuance costs and interest. The last two locations were added for flexibility as the bike boulevard design is moving through public process.
