Approve request to rezone, Z-18-00364, approximately 4.31 acres from the CO (Office Commercial) District to CN2 (Neighborhood Commercial) District, located 2110, 2120, & 2130 Exchange Court and adopt on first reading Ordinance No. 9614.

 

Executive Summary:

 

An application was submitted by CFS Engineers on behalf of Eastside Acquisitions LLC, the property owner of record, to rezone approximately 4.31 acres located at 2110, 2120, & 2130 Exchange Court from CO (Commercial Office) District to CC200 (Community Commercial) with restrictions.

 

The stated reason for the initial request was to allow more flexibility for commercial development of the lots. The applicant states that the CO District had existed since the mid-2000’s without any development interest in the property despite aggressive marketing of the property. The applicant proposed rezoning to CC200, with a list of restricted use, in an attempt to address neighborhood-scale development of the site.

 

Staff agreed with the applicant that the CO (Commercial Office) District was not appropriate.  Staff did not concur that the CC200 (Community Commercial) District zoning was appropriate for the southwest corner of the node. The CN2 District permits most of the uses the applicant indicated were desirable. Staff recognized that while some uses in the CC200 District are allowed by-right, in the CN2 District those uses are allowed via a special use permit, such as a gas and fuels sales or fast order food.

 

The Land Development Code provides a mechanism for the Planning Commission to consider an alternative to an affirmative or negative action on this specific request. The Planning Commission may consider and recommend a zoning district that is less intense than the request without requiring a new public hearing per the lesser change table found in Section 20-1303 of the Land Development Code.

 

The Planning Commission considered this item at their November 14, 2018 meeting and voted 8-2 to forward a positive recommendation to change the zoning from the CO district to the CN2 district rather than the CC200 district that was requested by the applicant.
