Discussion of items related to Queens Road project benefit districts 

 

This memorandum explains the purpose of the following agenda items (Regular Agenda, 1 and 2) related to the two benefit districts established to fund the Queens Road improvements.

 

Two action items related to the Queens Road project and benefit districts are scheduled for the December 4, 2018, City Commission agenda. The first is to receive and make a determination regarding the sufficiency of a protest petition submitted concerning the Queens Road benefit district and the Queens/Branchwood & 6th Street intersection benefit district. The second is to conduct a public hearing regarding the maximum amount of special assessments to be levied against properties in the Queens Road benefit district and the Queens/Branchwood & 6th Street intersection benefit district. Public comments regarding these two action items will be accepted in accordance with the City Commission’s established rules and procedures governing its meetings.

 

The City Attorney advises that general comments regarding the advisability of the creation of the benefit districts, the advisability of the improvements, the boundaries of the benefit districts, the method of assessment, and other matters already considered and decided by the Governing Body’s approval of Resolution No. 7267 are not relevant to the two action items on the December 4, 2018 City Commission agenda. Comments related to those matters were considered by the City Commission in multiple public meetings since June 6, 2017 and most recently on October 2, 2018 when the Commission conducted the public hearing regarding the establishment of the benefit districts prior to approval of Resolution No. 7267.
