Adopt on first reading, Ordinance No. 9575, allowing registered Accessory Dwelling Units to be utilized as a Short-term Residential Rental Property.

 

Executive Summary:

On October 2, 2018, the City Commission adopted Ordinance No. 9481, establishing short-term rentals as an accessory use to the principal household living use when the unit is owner-occupied, and as a Special Use when the unit is not owner-occupied.  At that time, the City Commission also adopted Ordinance No. 9560 establishing the short-term rental licensing and inspection program.

 

An inconsistency between the two ordinances creates a situation that excludes a property owner from renting a registered Accessory Dwelling Unit as a Short-Term Rental use.  Ordinance No. 9481 establishes Section 20-554(2)(ii) in the Land Development Code, which states, “The Short-Term Rental use shall be considered an Accessory Use when the Short-Term Rental is located on a property with a registered Accessory Dwelling Unit.”  Staff intended for Accessory Dwelling Units to be permitted as a short-term rental and even reflected this in the Frequently Asked Questions presented with the information to the City Commission.  However, Ordinance No. 9560, creates Section 6-13A03(c) stating, “It shall be unlawful for any Owner or Person to use an Accessory Dwelling Unit as Short-term Residential Rental Property.”

 

Ordinance No. 9575 would remove Section 6-13A03(c) enacted in Chapter 6, Article 13A, thereby allowing a short-term rental unit to be permitted within a registered Accessory Dwelling Unit.
