SPECIAL USE PERMIT NO. SUP-18-00363
BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS:
SECTION 1. In accordance with City of Lawrence, Kan., Code §§ 20-1306 and 20-1307(c)(2) (Jan. 1, 2018), as amended, the Governing Body of the City of Lawrence, Kansas, hereby grants to the owner/applicant Special Use Permit, No. SUP-18-00363, for that real property, commonly known as 325 Maine Street, Lawrence, Douglas County, Kansas, and bearing the following legal description, to-wit:
LOT 1, BLOCK 1, LAWRENCE MEMORIAL HOSPITAL NO 2. A REPLAT OF LOT 2, BLOCK 1, LAWRENCE MEMORIAL HOSPITAL ADDITION AND ALL OF LOTS 74, 76, 78, 80, 82, 84 AND PART OF LOT 86, IN BLOCK 24, WEST LAWRENCE A SUBDIVISION IN THE OF LAWRENCE, DOUGLAS COUNTY KANSAS: AND;
LOTS 1, BLOCK 1 LAWRENCE MEMORIAL HOSPITAL ADDITION, A REPLAT OF LOTS 43 THROUGH 48 BLOCK 6, BLOCKS 10, 11, 22 & 23, LOTS 73, 75, 77, 79, 81, 83, 85, 87 & 89 ON ARKANSAS STREET, BLOCK 24 & LOTS 71, 73, 75, 77 & 79 ON ELLIOTT STREET (NOW 4TH STREET), BLOCK 24 OF WEST LAWRENCE, A SUBDIVISION IN THE CITY OF LAWRENCE, DOUGLAS COUNTY, KANSAS, AND;
LOT 74, BLOCK 21, WEST LAWRENCE, ALSO VACATED 3RD STREET R/W ADJACENT SAID LOT PER ORDER OF VACATION FILED 6/19/14 IN BOOK 1114/3092, A Subdivision in the city of Lawrence, Douglas County, Kansas, AND;
LOTS 80, 82, 84 & NORTH 1/2 LOT 86, BLOCK 21, WEST LAWRENCE, A Subdivision in the city of Lawrence, Douglas County, Kansas.
approving the Institutional Development Plan (Revised LMH Hospital Master Plan) and permitting that real property to have that special use, as set forth in Section 2, infra, subject to the conditions established in Section 3, infra.
SECTION 2. The City hereby approves the Institutional Development Plan (Revised LMH Hospital Master Plan) and hereafter permits the subject real property, as granted in Section 1, supra, in accordance with Special Use Permit, No. SUP-18-00363, to have the following special use: Hospital.
SECTION 3. Approval of the Institutional Development Plan (Revised LMH Hospital Master Plan), the Special Use Permit granted in Section 1, supra, and the permitted special use described in Section 2, supra, are subject to the general conditions established in Chapter 20 of the Code of the City of Lawrence, Kansas, 2018 Edition, as amended, and are also subject to the following condition:
(a) Prior to recording the Institutional Development Plan with the Office of the Register of Deeds, the owner/applicant shall submit to the Planning Department an exhibit/map (watershed map) indicating the pervious/impervious breakdown on the Property Surface Summary Table in accordance with the requirements of the City Stormwater Engineer.
SECTION 4. Failure of the applicant, owner, or any successor or assign to abide by the requirements of Chapter 20 of the Code of the City of Lawrence, Kansas, 2018 Edition, as amended, shall be cause for the City to revoke Special Use Permit, No. SUP-18-00363, in accordance with City of Lawrence, Kan., Code § 20-1605 (Jan. 1, 2018), as amended.
SECTION 5. If any section, sentence, clause, or phrase of this ordinance is found to be unconstitutional or is otherwise held invalid by any court of competent jurisdiction, it shall not affect the validity of any remaining parts of this ordinance.
SECTION 6. This ordinance shall be in full force and effect from and after its passage and publication as provided by law.
