Authorize the City Manager to execute a License Agreement, permitting Climate Storage, L.L.C., a Kansas Limited Liability Corporation, to use an existing sign in the right of way at a property they own along the south side of 1547 E. 23rd Street. |

Executive Summary: |
The owners of the property located at 1547 E. 23rd Street have requested a license agreement that would allow them to retain an existing sign that is located within city-owned right of way. An approved site plan from 1972 shows the sign was originally placed on private property but that portion of frontage along E. 23rd Street was acquired and dedicated as right-of-way. During the site plan comment period, the City Engineer declined right-of-way vacation for this site.
This license agreement is in conjunction with the Standard City Site Plan Development Project, SP-18-00270. This site plan converted the formerly vacant space into a climate controlled, indoor storage facility and was administratively approved on 08/13/2018, subject to the applicant obtaining a Use of Right-of-Way agreement for the existing sign.
The sign does not restrict other public access to the right of way or the sidewalk adjacent to the property. Staff has also reviewed any possible impacted existing infrastructure within the right of way and determined that the sign will continue to not have any impact. The most recent approved site plan, SP-18-00270, marks the sign’s location in relation to surrounding public and private utility infrastructure.
Separate sign permits are required for development. Barry Walthall in Development Services will process the applicant’s sign permit application. |
