Recommendations/Options/Action Requested:

 

Adopt on second and final reading, Ordinance No. 9560, establishing a licensing and inspection program for short-term rentals.

 

Executive Summary:

At the City Commission meeting on September 18, 2018, staff presented Ordinance No. 9560 for adoption.  After staff’s presentation followed by public comment, the City Commission adopted Ordinance No. 9560 with the direction to incorporate language to require an Owner Occupied Short-term Residential Rental Property to send notice to all property owners within 200 feet of the proposed Short-term Residential Rental Property. This language is required to meet the City Commission’s previous direction and to match the answer to question #8 (Will I be notified of a short-term rental in my neighborhood?) of the Short-term Rental Frequently Asked Questions document that was attached to the agenda. The language is located in section 6-13A06 (e) of the code.

 

In addition, staff has modified Ordinance No. 9560 to reflect the following:

 

·         The definitions of “Non-owner Occupied” and “Owner Occupied” have been amended respectively in regard to the number of days an owner resides within any Dwelling Unit for such unit to be considered a Non-owner Occupied vs. an Owner Occupied Short-term Residential Rental Property.  The ordinance had previously identified 271 and 270 days which have now been reduced to 183 and 182 days to match the answer to question #7 (How is “owner occupied’ defined?) of the Short-term Rental Frequently Asked Questions document that was attached to the agenda.  Staff has consistently recognized a Dwelling Unit to be Owner Occupied when the Owner resides for more than half of a calendar year within such Dwelling Unit.

 

·         The effective date of the ordinance has been established as November 1, 2018 to provide staff sufficient time to prepare for the implementation of the program.
