Approve request to rezone, Z-18-00255, approximately 0.81 acres located at 708 Elm Street from RS7 (Single-Dwelling Residential) District to RSO (Single-Dwelling Residential-Office) District and adopt on first reading Rezoning Ordinance No. 9565.

 

Executive Summary:

 

An application was submitted by Lauren Davis of TreanorHL on behalf of the Elizabeth Ballard Community Center, the property owner of record, to rezone approximately 0.81 acres or approximately 35,283 square feet located at 708 Elm Street from RS7 (Single-Dwelling Residential) District to RSO (Single-Dwelling Residential-Office) District.

 

The property contains a two-story structure that houses the Ballard Center’s Early Education and donation programs. The Early Education program is classified as a Day Care Center use in the Land Development Code. This use is permitted in the RSO District as a Community Facility use. The food, clothing and home good donation program is classified as a Social Service Agency use in the Land Development Code. Social Service Agency is not a permitted use in the current zoning district, RS7 (Single-Dwelling) Residential. The rezoning was requested as a mechanism to bring the existing Social Service Agency use into compliance. The Ballard Center is looking to expand its clothing donation program which would constitute the expansion of a non-conforming use which is not permitted by the Land Development Code. Rezoning to RSO (Single-Dwelling Residential-Office) would permit the expansion of the Social Service Agency use as it is a permitted use in the district.

 

The rezoning request is accompanied by a site plan application, SP-18-00253. This application addresses the addition of onsite accessory structures for clothing donation and sorting. SP-18-00253 is currently under staff review.

 

The Planning Commission considered the item at their August 22, 2018 meeting and voted unanimously to forward the rezoning request to the City Commission with a recommendation for approval.
