ORDINANCE NO. 9426

 

AN ORDINANCE OF THE CITY OF LAWRENCE, KANSAS, REZONING APPROXIMATELY 8.745 ACRES FROM IG (GENERAL INDUSTRIAL) DISTRICT TO IL (LIMITED INDUSTRIAL) DISTRICT AND AMENDING THE CITY’S “OFFICIAL ZONING DISTRICT MAP,” INCORPORATED BY REFERENCE INTO THE CITY CODE AT CHAPTER 20, ARTICLE 1, SECTION 20-108 OF THE CODE OF THE CITY OF LAWRENCE, KANSAS, 2015 EDITION, AND AMENDMENTS THERETO.

 

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS:

 

SECTION 1. The base zoning district classification for the following legally described real property, situated in the City of Lawrence, Douglas County, Kansas, to-wit:

 

All of Lots 24, 33 and 34, Lawrence Industrial Park together with that part of Lot 1, Block 1, Lawrence Industrial Park No. 2, to include those certain right of ways adjoining Streets, Avenues, Terraces, Lanes and Railroads, both being recorded subdivisions in the City of Lawrence, Douglas County, Kansas, lying in the Southeast Quarter of Section 7, Township 13 South, Range 20 East of the 6th Principal Meridian, being more particularly described as follows:

 

Beginning at the Southeast Corner of the Southeast Quarter of said Section 7, also being the centerline intersection of East 30th Terrace (formerly 31st Street) and Haskell Lane (formerly Haskell Avenue); thence South 89 degrees 03 minutes 05 seconds West, along the South line of the Southeast Quarter of said Section 7 and the centerline of said 30th Terrace, a distance of 456.90 feet; thence North 1 degree 28 minutes 55 seconds West, being parallel with the east line of the Southeast Quarter of said Section 7, a distance of 30.00 feet to a point on the North right of way line of East 30th Terrace, also being a point on the South line of said Lot 1, Block 1, Lawrence Industrial Park; thence continuing North 1 degree 28 minutes 55 seconds West, being parallel with the east line of the Southeast Quarter of said Section 7, a distance of 343.87 feet to a point on the Easterly line of said Lot 1, also being the centerline intersection of  the vacated A.T.S.F Railroad as described in Book 695 at page 1414, with the centerline of East 30th Street; thence North 88 degrees 59 minutes 05 seconds East, along the centerline of said East 30th Street, a distance of 176.89 feet; thence North 1 degree 28 minutes 55 seconds West, a distance of 30.00 feet to a point on the North right of way line of said East 30th Street, also being the Southwest corner of said Lot 33, Lawrence Industrial Park No. 2; thence continuing North 1 degree, 28 minutes 55 seconds West, along the West line of said Lots 33 and 24, Lawrence Industrial Park No. 2, a distance of 690.00 feet to the Northwest corner of said Lot 24, also being a point on the South Right of Way line of East 29th Street; Thence continuing North 1 degree, 28 minutes 55 seconds West, a distance of 30.00 feet to a point on the centerline of said East 29th Street; Thence North 88 degrees 59 minutes 05 seconds East, along the centerline of East 29th Street, a distance of 280.00 feet to the centerline intersection of said 29th Street and Haskell Lane, also being a point on the East line of the Southeast Quarter of said Section 7; Thence South 1 degree 28 minutes 55 seconds East, along the centerline of said Haskell Lane, also being the East line of the Southeast Quarter of said Section 7, a distance of 1124.41 feet to the point of beginning. Containing 380,930 square feet or 8.745 acres, more or less.

is hereby changed from IG (General Industrial) District to IL (Limited Industrial) District, as such district is defined and prescribed in Chapter 20 of the Code of the City of Lawrence, Kansas, 2015 Edition, and amendments thereto.

 

SECTION 2. The “Official Zoning District Map,” which is adopted and incorporated into the City Code by reference at City of Lawrence, Kan., Code § 20-108 (Jan. 1, 2015), is hereby amended by showing and reflecting thereon the new zoning district classification for the subject property as described in more detail in Section 1, supra.

 

SECTION 3 If any section, sentence, clause, or phrase of this ordinance is found to be unconstitutional or is otherwise held invalid by any court of competent jurisdiction, it shall not affect the validity of any remaining parts of this ordinance. 

 

SECTION 4. This ordinance shall be in full force and effect from and after its passage and publication as provided by law.
