Recommendations/Options/Action Requested:

 

Consider adopting Charter Ordinance No. 45, providing that K.S.A. 13-1017, and amendments thereto, shall not apply to the City of Lawrence, providing that the City shall be exempt therefrom, providing substitute provisions, and repealing Charter Ordinance No. 19, if appropriate.

 

Executive Summary:

With the goals of delivering the highest quality projects on time and within budget while also meeting or exceeding the public’s project expectations, many Kansas cities and the State of Kansas have amended their laws to authorize the construction or reconstruction of public improvement projects through alternative construction delivery methods.  Melinda Harger, Utilities Engineer, has provided information about the various project delivery methods in use today in our region. 

 

The City of Lawrence has traditionally employed the traditional design-bid-build project approach.  However, the City has also had success using the design-build approach.  Ms. Harger’s memorandum also discusses the City’s past project experiences.

 

If the Commission desires to consider using alternative construction delivery methods in future City public improvement projects, I recommend we amend Charter Ordinance 19 to expressly authorize use of such methods.  Charter Ordinance No. 19 was passed in 1984, at a time when use of such construction delivery methods was not common.  Adopting Charter Ordinance No. 45 will update the City Code and provide greater clarity on the subject. 

 

Please see the attached memorandum providing additional information on proposed Charter Ordinance No. 45. To amend a charter ordinance, the governing body must adopt another charter ordinance.  A summary of the special procedures for passage of a charter ordinance is also set forth in the attached memorandum.
