City Commission request for Vermont Place NRA Plan revisions

 

 

In response to a request made by the City Commission at the Vermont Place public hearing held on October 3, 2017, legal staff has revised the corresponding NRA plan adding language to tighten up restrictions on the Applicant’s private residential use within the project.  Below shows original and revised language for the NRA Plan:

 

Original Plan language:

 

The Schumms, the Developer, and their affiliates by whatever name or form shall be ineligible for a NRA Tax Rebate on any Parcel Unit within the Neighborhood Revitalization Area used by the Schumms as a personal residence, i.e., as a place where the Schumms or their guests engage in activities associated with a personal residence and daily living, such as cooking, sleeping, bathing, etc.

 

Revised Plan language:

 

The Schumms, the Developer, and their affiliates, by whatever name or form, shall be ineligible for an NRA Tax Rebate on any Parcel Unit within the Neighborhood Revitalization Area used by the Schumms as a personal residence, i.e., as a place where the Schumms or their guests engage in activities associated with a personal residence and daily living, such as cooking, sleeping, bathing, etc., regardless of whether the Schumms, the Developer, or their affiliates, own, lease, or let the Parcel Unit, regardless of whether any consideration is given therefor, and regardless of whether the Parcel Unit is used as a primary or secondary residence.
