Recommendations/Options/Action Requested:

 

Approve Special Use Permit, SUP-17-00496, for the Manufacturing & Production, Limited and Retail, General uses located at 401 Elm Street and adopt on first reading Ordinance No. 9418.

 

Executive Summary:

 

The Special Use Permit application was submitted to allow the Manufacturing & Production, Limited use and the Retail, General use on the property at 401 Elm Street. The request would bring an existing woodworking shop into compliance with the Development Code, as well as facilitate the development of a portion of the structure into retail space.

 

This Special Use Permit is accompanied by a rezoning request, Z-17-00322, and a proposed Text Amendment, TA-17-00495. The rezoning request would rezone the property from the RS5 (Single-Dwelling Residential) District to the MU (Mixed Use) District. The text amendment would permit the Manufacturing & Production, Limited and Retail, General uses (and other nonresidential uses) in the Tertiary Development Zone of the Mixed Use District with approval of a Special Use Permit.

 

The Special Use Permit process allows conditions to be placed on uses to help mitigate potential impacts with the surrounding area. The following conditions are included with the proposed Special Use Permit:

a.    Exterior storage of materials, equipment or products is prohibited. Exterior fabrication of products is prohibited.”

b.    “The maximum noise level associated with the Manufacturing and Production, Limited use shall not violate the provisions of the City’s noise ordinance.”

c.     “Truck deliveries or pick-ups of supplies or products, associated with the nonresidential uses are allowed only from 7 a.m. to 9 p.m. Vehicles used for delivery and pick-up are limited to those normally servicing residential neighborhoods.”

 

The Planning Commission considered the item at their September 27, 2017 meeting and voted unanimously to forward the rezoning request to the City Commission with a recommendation for approval, subject to the following conditions:

1.    Provision of a site plan performance agreement.

2.    The applicant shall provide a revised site plan showing the dimensions of the on-street parking spaces to comply with design standards.

3.    The applicant shall provide a revised site plan with the following note:

“The hours of operation associated with the Manufacturing and Production, Limited use shall be during the hours of 7 a.m. and 9 p.m. Change in hours of operation to the Manufacturing and Production, Limited use would be subject to a new public hearing by the Planning Commission with approval by the City Commission”.
