EXTENSION OF LEASE AGREEMENT

 

            This Extension of Lease Agreement is made and entered into this _______ day of October, 2017, by and between the City of Lawrence, Kansas, a municipal corporation, hereinafter referred to as the “Lessor,” and The Shelter, Inc., a Kansas corporation, hereinafter referred to as the “Lessee.”

 

            WHEREAS, the Lessor and Lessee have entered into a certain Lease Agreement dated September 29, 1982 and Extension and Amendment of Lease Agreement, dated December 1, 1987, and an Extension and Amendment of Lease Agreement dated 1993, and an Extension and Amendment of Lease Agreement dated 2002, and an Extension of Lease Agreement dated December 5, 2007, and an Extension of Lease Agreement dated January 3, 2013 (collectively, the “Lease”) for the following described real estate located in the City of Lawrence, Douglas County, Kansas and commonly known as 342 Missouri Street, Lawrence, Kansas (the “Property”):

 

South 125 feet of Lot 55, Block 22, and the East ˝ of the South 125 feet of Lot 57, Block 22, West Lawrence, together with all improvements thereto and appurtenances thereon.

 

            WHEREAS, the Property was part of a replat in 2006 that contained the above Property, said plat was filed October 10, 2006 with the Douglas County Register of Deeds and recorded as a final plat of Lawrence Memorial Hospital Addition, in Plat Book 18, Page 69, and;

 

            WHEREAS, the Property has been surveyed and is now described as follows:

 

A portion of Lot 2, Block 1, Lawrence Memorial Hospital Addition, a subdivision in the City of Lawrence, Douglas County, Kansas, and more particularly described as follows: Commencing at the Southeast corner of said Lot 2, Block 1, thence South 83 degrees 51 minutes 36 seconds West on the South line of said Lot 2, a distance of 161.96 feet for the Point of Beginning; thence continuing South 83 degrees 51 minutes 36 seconds West on the South line of said Lot 2, a distance of 88.23 feet; thence North 06 degrees 04 minutes 46 seconds West, a distance of 97.26 feet; thence North 84 degrees 16 minutes 39 seconds East, a distance of 87.34 feet; thence South 06 degrees 36 minutes 19 seconds East, a distance of 96.63 feet, to the Point of Beginning; containing 8,509.7 square feet more or less all in the City of Lawrence, Douglas County, Kansas, Subject to Rights-of-way, Easements and Restrictions of Record.

 

            WHEREAS, the Lease shall expire on January 1, 2018, and the parties desire to extend the terms of the lease agreement.

 

            In consideration of the covenants contained in the earlier agreements and in this agreement, the Lessor and Lessee agree as follows:

 

            1.         The Lessor and Lessee agree to extend the terms of the Lease for a period of five years, commencing on January 1, 2018, and ending January 1, 2023.

 

            2.         The terms and conditions of the earlier agreements, except for the term of the lease (specifically provided herein), shall continue in effect for the term of the extension as provided in paragraph numbered 1.
