Adopt on first reading, Ordinance No. 9399, granting to Midcontinent Communications, a South Dakota general partnership, d/b/a Midco, a nonexclusive telecommunications franchise and authorize the City Manager to execute a Video Service Provider’s Agreement with Midco, if appropriate.

 

Executive Summary:

 

 

 

As a condition of the City’s approval of the assignment of WOW! and its assets to Midco, Midco agreed to enter into a revised telecommunications franchise contract and a Video Service Provider’s Agreement with the City. City staff and Midco have reached tentative agreements on both fronts. The agreements would govern the parties’ rights regarding Midco’s use of the public rights of way to provide telephone and cable television services to the residents of Lawrence. City staff recently completed a draft that would revise the City’s Right of Way Ordinance and the new agreements would be consistent with those provisions. It should be noted that Midco has acceded to the City on all points in both agreements. Accordingly, it is the recommendation of the City Attorney’s Office that the City Commission adopt on first reading, Ordinance No. 9399, granting to Midco a nonexclusive telecommunications franchise and authorize the City Manager to execute a Video Service Provider’s Agreement with Midco.
