Recommendations/Options/Action Requested:

 

Approve site plan, SP-17-00220, for conversion of former Jayhawk Bookstore at 1420 Crescent Road to a restaurant, Fast Order Food, retaining the two existing upstairs apartments, Non-Ground Floor Dwellings and approve the Use of Right-of-Way License for off-street parking on Naismith Drive.

 

Executive Summary:

The structure at 1420 Crescent Road formerly contained the Jayhawk Bookstore and two upstairs apartments. These uses were nonconforming in the zoning district until the property was rezoned to the MU (Mixed Use) District to remove the nonconformity. One condition of the rezoning was that any site plan for a change in use would require City Commission approval following public notice. Notice has been provided as required in the rezoning ordinance, attached.

 

The site plan proposes to locate a restaurant, McClain’s Market in the building, which would be a change in use from General Retail Sales to Fast Order Food. Few external changes are being proposed with this site plan. A sidewalk will be added along the Naismith Drive frontage and the trash enclosure will be relocated to the west side of the building.

 

The MU District allows the use of on-street parking. A license for the use of right-of-way for existing parking located in the Naismith Drive right-of-way is provided with this site plan. The MU District provided a reduction in parking requirements for properties adjacent to a transit stop. When rezoned, the property contained a transit stop but that has been removed due to safety reasons. On July 5th, 2017, the Board of Zoning Appeals approved a variance from the off-street parking requirement of 56 cars to permit the development to proceed with 30 spaces.
