Authorize the City Manager to execute a Construction and Access Agreement with the University of Kansas and HERE Lawrence Property Owner, LLC, if appropriate. |

Executive Summary:
|
In order for HERE to complete, in 2018, construction of its parking lot (in order to increase occupancy of the HERE mixed-use structure) and to complete the relocation of Fambrough Drive, the City, KU, and HERE have reached a tentative agreement governing the rights and obligations of the parties regarding the construction and HERE’s use of KU property during that construction. Under the terms of the proposed agreement, among other things, HERE would commence construction no earlier than May 14, 2018, and would complete construction no later than August 3, 2018. If it fails to complete the work in a timely manner, then HERE agrees to pay to KU and the City, each, the sum of $1,500.00 per day in liquidated damages for each day beyond August 3, 2018, that the work is not completed. The work will be completed to City standards, subject to inspection and approval of the City.
