AN ORDINANCE OF THE CITY OF LAWRENCE, KANSAS, AMENDING SECTION 16-504 OF THE CODE OF THE CITY OF LAWRENCE, KANSAS, 2015 EDITION, AND AMENDMENTS THERETO, PERTAINING TO THE EQUIVALENT RESIDENTIAL UNIT (ERU) RATE IN DETERMINING THE STORMWATER DRAINAGE CHARGE AND REPEALING EXISTING SECTION 16-504

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS:

Section 1. Section 16-504 of the Code of the City of Lawrence, Kansas, 2015 Edition, and amendments thereto, is hereby amended to read as follows:

16-504 ERU RATE: ADMINISTRATION.

The Equivalent Residential Unit (ERU) rate shall be Four Dollars and Twelve Twenty-four Cents ($ 4.12 4.24) per month.  The City Manager shall have the authority to promulgate rules and regulations for the determination of Stormwater Drainage Charges to ensure their equitable and consistent application.

SECTION 2. Existing section 16-504 of the Code of the City of Lawrence, Kansas, 2015 Edition, and amendments thereto, is hereby repealed, it being the intent of the Governing Body that the provisions of this ordinance supersede that section.

SECTION 3. If any section, clause, sentence, or phrase of this ordinance is found to be unconstitutional or is otherwise held invalid by any court of competent jurisdiction, it shall not affect the validity of any remaining parts of this ordinance.

SECTION 4. This ordinance shall take effect and be in full force and effect on November 15, 2017 and upon its publication as provided by law.
