Recommendations/Options/Action Requested:

 

Conduct a public hearing regarding a distance limitation waiver request for the 2017 Final Friday event to be held on Friday, September 29, 2017, from 9:00 a.m. to 11:59 p.m. The public hearing would apply to the 900 block of New Hampshire Street.

 

Find that the proximity of the temporary sale of alcoholic liquor for the event is not adverse to the public welfare or safety and a grant distance limitation waiver.

 

Adopt on first reading, Ordinance No. 9379, allowing the sale, possession and consumption of alcohol in the public right-of-way in the 900 block of New Hampshire Street on Friday, September 29, 2017, from 9:00 a.m. to 11:59 p.m. during the event.

 

 

Executive Summary:

The Lawrence Arts Center applied for a street event temporary use of right of way permit for its 2017 event, which will be held Friday, September 29, 2017, from 9:00 a.m. to 11:59 p.m.

 

The event will close the 900 block of New Hampshire Street.

 

The request to sell, possess and consume alcohol within the public right of way has been reviewed pursuant to City of Lawrence Code, Chapter IV, Article 1, Section 4-113. The event was found to be within 400 feet of a church or school. Pursuant to code requirements, staff notified the church on June 22, 2017 that a public hearing regarding this request will be held on August 1, 2017 at the City Commission Meeting.

 

Event notification was sent out for the event to adjacent property owners advising them of the event as well as being on the August 1, 2017 commission agenda. In addition to this notice, coordination with Parks and Recreation, Public Works, Police, Fire/Medical, Lawrence Transit, Downtown Lawrence, Inc., eXplore Lawrence, and Lawrence Association of Neighborhoods was completed with no issues being identified.

The fiscal impact to the City is $0.00. The City received a $10.00 permit fee and $70.00 to publish the alcohol ordinance.
