SPECIAL USE PERMIT NO. SUP-17-00153

 

AN ORDINANCE OF THE CITY OF LAWRENCE, KANSAS, GRANTING A SPECIAL USE PERMIT/INSTITUTIONAL DEVELOPMENT PLAN FOR A REVISION TO THE LMH MASTER PLAN AND CONSTRUCTION OF A NEW PARKING LOT ON THAT REAL PROPERTY, COMMONLY KNOWN AS 302, 306, 310, 314, 318 322 MICHIGAN STREET AND 302, 316, 320, 325 MAINE STREET, LAWRENCE, DOUGLAS COUNTY, KANSAS.

 

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS:

 

SECTION 1. In accordance with City of Lawrence, Kan., Code §§ 20-1306 and 20-1307(c)(2) (Jan. 1, 2015), as amended, the Governing Body of the City of Lawrence, Kansas, hereby grants to the owner/applicant Special Use Permit, No. SUP-17-00153, for an Institutional Development Plan for that real property, commonly known as 302, 306, 310, 314, 318, 322 Michigan Street AND 302, 316, 320, 325 Maine Street, Lawrence, Douglas County, Kansas, and bearing the following legal description, to-wit:

 

LOTS 1 & 2, BLOCK 1 LAWRENCE MEMORIAL HOSPITAL ADDITION, A Replat of Lots 43 through 48 Block 6, Blocks 10,11, 22 & 23, Lots 73, 75, 77, 79, 81, 83, 85, 87 & 89 on Arkansas Street, Block 24 & Lots 71, 73, 75, 77 & 79 on Elliott Street (now 4th Street), Block 24 of West Lawrence, A SUBDIVISION IN THE CITY OF LAWRENCE, DOUGLAS COUNTY, KANSAS, AND;

 

All of Lots 74, 76, 78, 80, 82, 84 and the North 15’ of Lot 86, in Block 24, West Lawrence, A Subdivision in the city of Lawrence, Douglas County, Kansas,

AND;

 

LOT 74, BLOCK 21, WEST LAWRENCE, ALSO VACATED 3RD STREET R/W ADJACENT SAID LOT PER ORDER OF VACATION FILED 6/19/14 IN BOOK 1114/3092, A Subdivision in the city of Lawrence, Douglas County, Kansas, AND;

 

LOTS 80, 82, 84 & NORTH 1/2 LOT 86, BLOCK 21, WEST LAWRENCE, A Subdivision in the city of Lawrence, Douglas County, Kansas.

 

permitting that real property to have that special use/institutional development plan set forth in Section 2, infra, subject to the conditions established in Section 3, infra.

 

SECTION 2. The City hereafter permits the subject real property, as granted in Section 1, supra, in accordance with Special Use Permit, No. SUP-17-00153, to have the following special use:  Hospital Master Plan and associated parking improvements.

 

SECTION 3. The Special Use Permit granted in Section 1, supra, and the permitted special use described in Section 2, supra, are subject to the general conditions established in Chapter 20 of the Code of the City of Lawrence, Kansas, 2015 Edition, as amended, is also subject to the following conditions:

 

1.    Approval of and publication of an ordinance to rezone 1.38 Acres from RS5 to H.

2.    Prior to recording of the Institutional Development Plan with the Register of Deeds Office the applicant shall:

a.    Revise and resubmit a drainage study per city Stormwater Engineer’s approval

b.    Provision of a stormwater pollution provision plan and a notice of intent approved by KDHE prior to construction site construction.

c.     Provide detailed plans for the construction of the parking lot and the installation of the pervious pavement per the approval of the City Stormwater Engineer.

d.    Submission of public improvement plans to the City for review and approval.

3.    Prior to recording of the Institutional Development Plan with the Register of Deeds Office the applicant shall provide a revised site plan with the following notes and changes:

a.    Show 9 parking spaces located along Woody Park for clarification on the drawings.

b.    Show sanitary sewer line extended to meet minimum City Code requirements for 326 and 330 Michigan Street per the approval of the City Utility Engineer.

c.     Revise the landscape plan to include additional shrubs along the north and south property lines to screen the parking lot from adjacent residence.

d.    Revise landscape plan to include additional shrubs and ornamental trees along Michigan Street.

e.    Provision of a note that states Public Improvements Plan are required for review and approval for the following improvements:

                                          i.    Storm sewer

                                         ii.    Sanitary sewer extension to 326 and 330 Michigan Street

                                        iii.    Sidewalk improvements

                                       iv.    Maine Street Crosswalks.

f.        Provision of a revised plan to show the location of a minimum of 123 bicycle parking spaces, the distribution and type of bicycle parking spaces (based on the APBP recommended rack design) and number of bike parking at each bike parking location subject to staff approval.

g.      Provision of a revised plan to show a conceptual 10’ connection of a shared-use path from Sandra Shaw trail through Woody Park or around the Hospital Property to 2nd and Michigan with a note on the face of the site plan that the alignment may be modified by the pending MPO study.

h.      Execution of an agreement to fund and construct shared-use path with phase 2 to install on-street parking spaces along Arkansas and Maine Streets.

 

SECTION 4. Failure of the applicant, owner, or any successor or assign to abide by the requirements of Chapter 20 of the Code of the City of Lawrence, Kansas, 2015 Edition, as amended, shall be cause for the City to revoke Special Use Permit, No. SUP-17-00153, in accordance with City of Lawrence, Kan., Code § 20-1605 (Jan. 1, 2015), as amended.

 

SECTION 5. If any section, sentence, clause, or phrase of this ordinance is found to be unconstitutional or is otherwise held invalid by any court of competent jurisdiction, it shall not affect the validity of any remaining parts of this ordinance. 

 

SECTION 6.  This ordinance shall be in full force and effect from and after its passage and publication as provided by law.
