Adopt on first reading Ordinance 9373 pertaining to seat belts and the fines associated with failure to wear a seatbelt. |

Executive Summary: |
Effective July 1, 2017, the penalty for any adult failing to properly wear a seat belt while in a moving passenger car will increase from $10 to $30. The additional $20 penalty will be remitted to the state under the new law.
The state law provides that it shall be applicable and uniform throughout the state and that no city shall enact or enforce any ordinance in conflict with, in addition to, or supplemental to, its provisions.
Each year the City of Lawrence adopts the newest version of the Standard Traffic Ordinances (STO), but the most recent version will not be available and up for adoption by the City Commission until later this summer or early fall. That newer STO booklet should reflect the $30 change, but staff recommends adopting the current ordinance so that the City is immediately consistent with state law rather than waiting until the new STO booklet is released and adopted later this year. |

Fiscal Impact (Amount/Source): |
There is no fiscal impact to the City, as the additional $20 collected through the amended state statute shall be remitted to the State of Kansas (see K.S.A. 8-2504 as amended by Sec. 7(c) of the attached Senate Bill). This item was not included in the 2017 budget or CIP, as it has no fiscal impact to the City and because it was adopted by the Kansas Legislature late in the 2017 session.
