Conduct a public hearing regarding distance limitation waiver request for the 2017 Live on Mass event to be held Saturday, June 24, 2017 from 11:00 a.m. to 11:00 p.m. on the 1000 block of Massachusetts Street.
Find that the proximity of the temporary sale of alcoholic liquor for the event is not adverse to the public welfare or safety and a grant distance limitation waiver.
Adopt on first reading Ordinance No. 9358, allowing the sale, possession and consumption of alcohol on the public right-of-way on Saturday, June 24, 2017 on the 1000 block of Massachusetts Street for the Live on Mass event. |

Executive Summary: |
The Live on Mass event organizers have applied for street event temporary use of right-of-way permit for their 2017 event which will be held on Saturday, June 24, 2017. The event will include the closure of the 1000 block of Massachusetts Street for the event.
The event applicant has requested an ordinance authorizing the sale, possession and consumption of alcohol in the 1000 block of Massachusetts Street for the event.
The request to sell, possess and consume alcohol within the public right-of-way has been reviewed pursuant to City of Lawrence Code, Chapter IV, Article 1, Section 4-113 and was found to be within 400 feet of a church or school. Pursuant to code requirements, staff notified the church on April 4, 2017 that a public hearing regarding this request would be held on May 16, 2017 at the City Commission Meeting. The affected area for this event is the 1000 block of Massachusetts Street.
Event notification was sent out to adjacent property owners advising them of the event as well as being on the May 16, 2017 commission agenda. In addition to this notice, coordination with Parks and Recreation, Public Works, Police, Fire/Medical, Downtown Lawrence Inc., Lawrence Transit, Explore Lawrence, and Lawrence Association of Neighborhoods was completed with no issues being identified.

Fiscal Impact (Amount/Source): |
The recommended action has no fiscal impact on the city. The event organizers did apply for and were awarded Transient Guest Tax grant program funding for this event in the amount of $7,500.
The applicant has paid the city $10 for the street closure permit and $70 for the ordinance publication costs. Additionally the applicant will pay for 44 no parking signs the ($44 cost to the applicant). |
