Adopt on first reading, Ordinance No. 9344, allowing the sale, possession and consumption of alcohol on Sunday, May 14, 2017 at 10:00 a.m. to 5:00 p.m. in South Park and on Massachusetts Street between North Park and South Park Street associated with the 2017 Art in the Park Event (rain date); provided the sale, possession and consumption are pursuant to City of Lawrence and State of Kansas law

Executive Summary: |
The Lawrence Art Guild has been granted a temporary use of right of way street event permit to close Massachusetts Street from North Park Street to South Park Street on Sunday, May 7, 2017 from 6:00 a.m. to 7:30 p.m. for the 2017 Art in the Park Art Fair. This event has been held annually in South Park and on Massachusetts Street. They have set a rain date for their event for Sunday, May 14, 2017. This ordinance will allow the sale, possession and consumption of alcohol on the rain date as well.
The request to sell, possess and consume alcohol within the public right of way has been reviewed pursuant to City of Lawrence Code, Chapter IV, Article 1, Section 4-113 and the event was found not to be within 400 feet of a church or school.
Possession and consumption of alcohol on the right-of-way is generally prohibited, unless the City Commission adopts an ordinance exempting an area from that prohibition. The attached Ordinance No. 9344 would temporarily allow the possession and consumption of alcohol on Massachusetts Street from South Park Street to North Park Street on Sunday, May 14, 2017 from 10:00 a.m. to 5:00 p.m. during this event, if their original event date of Sunday, May 7, 2017 is rained out.
Coordination with Planning, Parks and Recreation, Police, Fire/Medical, Lawrence Transit, eXplore Lawrence, East Lawrence Neighborhood Association, Lawrence Association of Neighborhoods and Down Town Lawrence, Inc. was completed with no issues identified. |
