Recommendations/Options/Action Requested:

 

Authorize the Mayor to execute a Stormwater Detention Waiver Agreement for the property located at 1801 W. 23rd Street (Hobby Lobby site).  Refer to Exhibit A for a legal description.

 

Executive Summary:

 

The intersection of 23rd Street & Ousdahl Road experiences flash flooding during heavy storm events and is frequently inundated and impassable to vehicular traffic. The existing storm sewer infrastructure currently provides for a 2-year or less design storm which results in localized street flooding.

 

BG Consultants was contracted to design a solution and recently completed construction plans which are currently out for bid to remedy the current situation.  The main branch of the project extends from the west property line of Schwegler School to a point on Naismith Creek approximately 400 feet south of the intersection of W. 24th Street and Naismith Drive. The project also includes the construction of a detention basin on the southwest corner of the Schwegler School parcel as well as geometric improvements, left turn lanes, on Ousdahl Road. Other improvements include the replacement of a sanitary sewer line and a new water main. 

 

The property owners of 1801 W. 23rd Street are dedicating permanent utility and construction easements for the new sanitary sewer line as mentioned above.  This dedication is in return for the waiver of any future stormwater detention requirements for this parcel particularly if it is subdivided. The Stormwater Management Criteria allows for up to a 10% increase in impervious surface without the requirement of detention. However when a property is redeveloped and/or subdivided this triggers a requirement for detention. The new storm sewer system has been designed to account for all of the existing stormwater runoff from this parcel.  Since the existing parcel is almost entirely encumbered with impervious surface it is logical to waive the need for future detention.
