Recommendations/Options/Action Requested:

 

Adopt on first reading Ordinance No. 9331, allowing the possession and consumption of alcohol on the 800 block of Pennsylvania, the 600 block of E. 9th Street, and the 600 block of E. 8th Street on Saturday May 6, 2017 from 12:00 P.M. to 11:59 P.M. during this event.

 

Executive Summary:

The Cider Gallery has requested a Street Event Temporary use of right-of-way permit for the Kansas Food Truck Festival, scheduled for Saturday, May 6, 2017. They request permission to close the 800 Block of Pennsylvania from 8th to 9th Streets, the 600 block of E. 9th Street and the 600 block of E. 8th Street. They also requested permission for the possession and consumption of alcohol associated with this event on the public right-of-way (see attached map).

 

The request to sell, possess and consume alcohol within the public right of way has been reviewed pursuant to City of Lawrence Code, Chapter IV, Article 1, Section 4-113 and the event was not found to be within 400 feet of a church or school.

 

Possession and consumption of alcohol on the right-of-way is generally prohibited, unless the City Commission adopts an ordinance exempting an area from that prohibition. The attached Ordinance No. 9331 would temporarily allow the possession and consumption of alcohol on the 800 block of Pennsylvania, 600 block of E. 9th Street and the 600 block of E. 8th Street on Saturday May 6, 2017 from 12:00 P.M. to 11:59 P.M. during this event.

 

The city has sent out notice of this event and pending City Commission action to adjacent property owners. (See attached notice). This notice included Penny’s Concrete and the City of Lawrence, Utilities Department. Access in and out of those locations will be maintained during the event. They have also obtained written support from the adjacent properties and business.

 

In addition, Police, Parks and Recreation, Public Works, Fire / Medical, Lawrence Transit, Downtown Lawrence, Inc., East Lawrence Neighborhood Association (ELNA), Lawrence Association of Neighborhoods and Explore Lawrence have reviewed this request. The event organizers have also reached out to the East Lawrence Neighborhood Association.

Fiscal Impact (Amount/Source):

The fiscal impact to the City is $256.00. This cost has, in previous years, been recouped through a reimbursement from the transient guest tax fund.
