ORDINANCE NO. 9323
A HOME RULE ORDINANCE OF THE CITY OF LAWRENCE, KANSAS, AUTHORIZING THE ISSUANCE OF GENERAL OBLIGATION BONDS OF THE CITY TO PROVIDE FUNDS FOR PREPAYMENT OF CERTAIN SPECIAL ASSESSMENTS RELATING TO THE DOWNTOWN PARKING GARAGE.
WHEREAS, the governing body of the City of Lawrence, Kansas (the “City”) has authorized the construction of an additional parking level for 70 parking spaces on the parking garage at 707 Vermont Street and other necessary and appropriate improvements (the “Project”); and
WHEREAS, in order to finance the Project, special assessments were authorized and levied in the total amount of $915,358.03 (the “Assessments”) against certain properties described in Exhibit A attached hereto (the “Benefit District”) pursuant to K.S.A. 12-6a01 et seq., Resolution No. 6995 and Ordinance No. ____ of the City; and
WHEREAS, the City desires to contribute an amount of $488,828.86 (the “City Contribution”), which amount shall be used by the City to prepay a portion of the Assessments on behalf of certain properties in the Benefit District, as further described in Exhibit A attached hereto, all to encourage and reward actions of such property owners to alleviate parking congestion in the downtown business corridor, thus promoting economic development in such area; and
WHEREAS, the City is authorized by Article 12, Section 5 of the Constitution of the State of Kansas (the “Home Rule Amendment”) to determine its local affairs and government, and provides that such power and authority granted thereby to cities shall be liberally construed for the purpose of giving to cities the largest measure of self-government; and
WHEREAS, there is no enactment of the Kansas Legislature which prohibits the City from issuing general obligation bonds or notes to finance the prepayment of a portion of special assessments for purposes of economic development; and
WHEREAS, the governing body of the City hereby finds that pursuant to and in furtherance of the purposes of the Home Rule Amendment, it is in the interest of the public health, safety and welfare of the City to authorize the issuance of general obligation temporary notes and/or bonds (the “Obligations”) for the purpose of financing the cost of the City Contribution, all for economic development purposes.
NOW THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS:
Section 1. Economic Development. The governing body of the City hereby finds and determines that the Project will stimulate and foster economic development in the City and its environs in order to enhance and provide for the general and economic development and welfare of the City and its citizens.
Section 2. Financing Authorization. The City Contribution may be paid, in whole or in part, from the proceeds of the Obligations, which are hereby authorized to be issued for such purposes pursuant to the authority of the Home Rule Amendment in the amount of $488,828.86, plus associated costs of issuance and interest on any temporary financing.
Section 3. Further Authority. The officials of the City and other consultants are authorized to proceed with such planning and document preparation as necessary in order to comply with the intent of this ordinance.
Section 4. Effective Date. This Home Rule Ordinance shall be effective from and after final passage by the governing body, approval and signature by the Mayor and publication once in the official City newspaper.
