Authorize the City Manager to execute License Agreements for the use of Right-of-Way with the property owners of 5621, 5627 & 5629 Chimney Rock Circle for the installation of sump pump drainage pipes. |

Executive Summary: |
The properties at 5627 & 5629 Chimney Rock Circle are experiencing significant ground water flows which cause their corresponding sump pumps to run almost continuously. Currently the discharge from the sump pumps at 5627 & 5629 Chimney Rock Circle are draining into the street and are causing the pavement to become slick with moss during the summer and slick with ice during the winter. Over time this will also lead to the deterioration of the street surface.
The license agreements allow for the placement of a drainage pipe along the right-of-way of 5621, 5627 and 5629 Chimney Rock Circle as well as a connection to the curb inlet adjacent to the property at 5621 Chimney Rock Circle. The property owners will be responsible for installation and maintenance as well as any relocation or removal costs in the event the City needs to use the right-of-way for the City’s purposes.
