RESOLUTION NO. 7179
A RESOLUTION OF THE CITY OF LAWRENCE, KANSAS, APPROVING CONDITIONALLY AN APPLICATION FOR LOW INCOME HOUSING TAX CREDITS FROM THE STATE OF KANSAS FOR "THE ESTATES OF LAWRENCE," A PROPOSED HOUSING DEVELOPMENT NOT CURRENTLY ADDRESSED BUT FRONTING ON EAST 1600 ROAD WITH A PARCEL ID NO. OF 102-09-0-00-00-006.00-0.
WHEREAS, Wheatland Investments Group, LLC, having a principal place of business at Gardner, Kansas, has informed the City of Lawrence, Kansas, that it will be filing a low income housing tax credit application with the Kansas Housing Resources Corporation for the proposed development of "The Estates of Lawrence," which shall include affordable rental housing for families, on that real property bearing the following legal description, to-wit:
Part of the Southwest Quarter of the Southwest Quarter of the Northwest Quarter of Section 9, Township 13 South, Range 20 East of the 6th P.M., Douglas County, Kansas described as follows:
Beginning at the Southwest corner of said Southwest Quarter of the Southwest Quarter of the Northwest Quarter; thence North 01°37'18” West, coincident with the West line of said Quarter section a distance of 209.19 feet; thence North 89°03'30” East, a distance of 256.00 feet; thence North 01°37'18” West, a distance of 256.89 feet; thence North 88°52'08” East, a distance of 413.08 feet to the East line of said Southwest Quarter of the Southwest Quarter of the Northwest Quarter; thence South 01°35'31” East, coincident with said West line a distance of 465.05 feet to the Southeast corner of said Southwest Quarter of the Southwest Quarter of the Northwest Quarter; thence South 88°51'12” West, coincident with the South line of said Southwest of the Southwest Quarter of the Northwest Quarter a distance of 668.83 feet to the point of beginning.
Said tract contains 245,496 square feet, (5.64 acres) of land more or less.
WHEREAS, the proposed housing development will contain 38 dwelling units that will be constructed;
WHEREAS, the proposed housing development will consist of two and three bedroom dwelling units, with each unit being two stories with a garage;
WHEREAS, the proposed housing development shall include 6 market rate and 32 affordable dwelling units to be marketed to families, with the affordable housing unit rents targeted at the 50% and 60% of area median income range; and
WHEREAS, if application for low income housing tax credits is approved by the Kansas Housing Resources Corporation, Wheatland Investments Group, LLC, has indicated that it will request assistance from the City of Lawrence Affordable Housing Trust Fund and a waiver of City building and permit fees.
NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS:
SECTION 1: The above-stated recitals are incorporated herein by reference as if set forth in full.
SECTION 2: The Governing Body of the City of Lawrence, Kansas, supports the application of Wheatland Investments Group, LLC, having its principal place of business at Gardner, Kansas, for low income housing tax credits from the Kansas Housing Resources Corporation for a proposed low income housing development, “The Estates of Lawrence," on that real property, the legal description of which is set forth in the recitals, supra, subject to the following conditions:
(a) the housing development includes, at a minimum, all commitments, appointments, and amenities, as set forth in the recitals; and
(b) the developer obtains all necessary land use, site plan, and building code approvals for the proposed housing development from the City of Lawrence, Kansas, Department of Planning and Development Services.
SECTION 3: The Governing Body hereby declares its intent to consider, but not commit to requests for assistance made by Wheatland Investments Group, LLC, for use of the city’s Affordable Housing Trust Fund funds or to waive certain development fees to construct the project.
SECTION 4: This Resolution shall be and remain effective until July 30, 2017. In the event that any of the described characteristics of the proposed housing development, as set forth in the recitals, supra, shall change prior to the issuance of a building permit, then this Resolution shall be deemed null and void.
