Approve Z-16-00306 and adopt Ordinance No. 9298 on first reading.

 

Ex parte communication – This is a quasi-judicial review and requires the City Commission to declare any ex parte communications.

 

Executive Summary:

An application was submitted on behalf of Reylan Properties, LC, property owner of record, to rezone approximately 30 acres located at the southeast corner of the intersection of W 31st and Michigan Streets from County A (Agriculture) to RM15 (Multi-Dwelling Residential).

 

The rezoning request and proposed use are compliant with the land use recommendations in the adopted area plan, The Revised Southern Development Plan, for medium density residential development. 

 

A concept plan provided with the rezoning request showed apartments being located in the northwest corner of the property, outside of the regulatory and the 500 year floodplain. Access would be taken from Michigan Street.  Per the concept plan, 240 dwelling units would be developed in the northwest corner of the site, with the first phase. Development of the southern portion would occur at a later date.

 

The surrounding area contains a mix of uses with Commercial, Open Space, and Medium-Density Residential, being the predominate uses. The subject property is bounded on the north by 31st Street, a Principal Arterial; on the south by K10/SLT, a Freeway; and on the west by Michigan Street, a Minor Arterial.  The rezoning is not expected to negatively impact nearby properties. Impacts will be evaluated and mitigated through the platting and site planning processes.

 

The Planning Commission considered this item at their September 26, 2016 meeting and voted unanimously to forward the rezoning request to the City Commission with a recommendation for approval.
