Recommendations/Options/Action Requested:

 

Approve a street event temporary use of right-of-way permit for the KU Homecoming Parade and Pep Rally event to use various downtown streets for the parade and to close the 100 block of East 8th Street for the pep rally on Friday, October 21, 2016 from 12:00 p.m. to 11:00 p.m., and to include the donation of Public Works and Police Department services.

 

Adopt on first reading, Ordinance No. 9270, allowing the sale, possession, and consumption of alcoholic liquor on public property on the 100 block of East 8th Street on Friday, October 21, 2016 from 12:00 p.m. – 11:00 p.m., for the KU Homecoming Pep Rally event.; provided the sale, possession and consumption of alcoholic liquor are pursuant to City of Lawrence and State of Kansas law.

 

Executive Summary:

The Kansas Alumni Association has requested a street event temporary use of right-of-way permit to use various downtown streets for the parade (see map 1) and to close the 100 block of East 8th Street  for the pep rally (see map 2) on Friday, October 21, 2016 from 12:00 p.m. to 11:00 p.m., and an ordinance to sell, possess and consume alcohol within the public right-of-way in the same block on Friday, October 21, 2016 from 12:00 p.m. to 11:00 p.m. for the KU Homecoming Parade and Pep Rally Event. They are also requesting the donation of Public Works and Police Department services in support of this event.

 

The parade will begin at 6:00 p.m. and the route will follow its traditional path from South Park north on Massachusetts Street, then east on 7th Street, then south on New Hampshire Street.

 

The request to sell, possess and consume alcohol within the public right-of-way has been reviewed pursuant to City of Lawrence Code, Chapter IV, Article 1, Section 4-113 and the event was not found to be within 400 feet of a church or school.

 

Possession and consumption of alcohol on the right-of-way is generally prohibited, unless the City Commission adopts an ordinance exempting an area from that prohibition. The attached Ordinance No. 9270 would temporarily allow the possession and consumption of alcohol on the 100 block of E 8th Street during this event.

 

Notice of this event and Commission consideration has been sent to the adjacent property owners.

 

In addition, Police, Parks and Recreation, Public Works, Fire / Medical, Lawrence Transit, Downtown Lawrence, Inc., Lawrence Association of Neighborhoods, and eXplore Lawrence have reviewed this permit.

Fiscal Impact (Amount/Source):

The fiscal impact to the City is, Public Works $1,200.00, Police $800.00 for a total of $2,000.00. This item was not in the 2016 Public Work or Police budget. The cost to support events by the City is typically absorbed within the respective departments operating budgets.
