A JOINT ORDINANCE OF THE CITY OF LAWRENCE, KANSAS, AND RESOLUTION OF DOUGLAS COUNTY, KANSAS, AMENDING CHAPTER 20, ARTICLE 8, SECTIONS 20-804 AND 20-806 OF THE CODE OF THE CITY OF LAWRENCE, KANSAS, 2015 EDITION, AS AMENDED, AND CHAPTHER 11, ARTICLE 1, SECTIONS   11-104 AND 11-106 OF THE CODE OF THE COUNTY OF DOUGLAS, KANSAS, AS AMENDED, PERTAINING TO SUBDIVISION REGULATIONS, BY ADOPTING AND INCORPORATING HEREIN BY REFERENCE “SUBDIVISION REGULATIONS FOR LAWRENCE AND THE UNINCORPORATED AREAS OF DOUGLAS COUNTY, KANSAS, AUGUST ____, 2016 EDITION, TEXT AMENDMENTS,” AS PREPARED BY THE LAWRENCE-DOUGLAS COUNTY METROPOLITAN PLANNING OFFICE, AND REPEALING EXISTING SECTIONS 20-804 AND 20-806 OF THE CITY CODE AND SECTIONS 11-104 AND 11-106 OF THE COUNTY CODE.

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS, AND BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF DOUGLAS COUNTY, KANSAS:

SECTION 1. Chapter 20 of the Code of the City of Lawrence, Kansas, 2015 Edition, and amendments thereto, and Chapter 11 of the Code of the County of Douglas, and amendments thereto, are hereby amended as follows:

There is hereby adopted and incorporated herein by reference, as if fully set forth herein, for the purpose of amending Chapter 20, Article 8, Sections 20-804 and 20-806  of the Code of the City of Lawrence, Kansas, 2015 Edition, and amendments thereto, and Chapter 11, Article 1, Sections 11-104 and 11-106 of the Code of the County of Douglas, Kansas, and amendments thereto, “Subdivision Regulations for Lawrence and the Unincorporated Areas of Douglas County, Kansas, August ____, 2016, Text Amendments,” as prepared and published by the Lawrence-Douglas County Metropolitan Planning Office.

SECTION 2: One copy of  “Subdivision Regulations for Lawrence and the Unincorporated Areas of Douglas County, Kansas, August ____, 2016, Text Amendments,” shall be marked “Official Copy as Adopted by Ordinance No. 9264 and Resolution 16-________” and to which shall be attached a copy of this joint resolution and ordinance, and filed each with the City Clerk and County Clerk, to be open for inspection and available to the general public at all reasonable business hours. One additional copy of the “Official Copy as Adopted by Joint Ordinance No. 9264 and Resolution No. ____” shall, at the cost of the City of Lawrence, Kansas, be made available to the Lawrence-Douglas County Planning Office. 

SECTION 3. The amendments to the Subdivision Regulations made by this joint resolution and ordinance shall be included as a supplement to the Code of the City of Lawrence, Kansas, 2015 Edition, and amendments thereto, and to the Code of the County of Douglas, Kansas, and amendments thereto. For the purposes of numbering sections in the Code of the County of Douglas, Kansas, the first two digits of each section shall be changed from 20 to 11 and the third digit (the first digit following the hyphen) shall be changed from 8 to 1. For instance, Sections 20-804 and 20-806 shall be numbered Sections 11-104 and 11-106, respectively, in the County Code.

SECTION 4. Existing sections 20-804 and 20-806 of the Code of the City of Lawrence, Kansas, 2015 edition, and amendments thereto, and sections 11-104 and 11-106 of the Code of Douglas County, Kansas, and amendments thereto, are hereby repealed in their entirety, it being the intent of the Governing Bodies of the City and the County that the provisions of this joint ordinance and resolution supersede those sections.

SECTION 5. If any section, sentence, clause, or phrase of this joint ordinance and resolution is found to be unconstitutional or is otherwise held invalid by any court of competent jurisdiction, it shall not affect the validity of any remaining parts of this joint ordinance and resolution. 

SECTION 6. This joint ordinance and resolution shall be in full force and effect from and after its passage and publication as provided by law.
