RE:	Ordinance No. 9269, Correction to Section 18-304 City Code to replace text that was inadvertently omitted with the Incorporation by Reference Document (IBR) for TA-15-00346 – Text Amendment to the Land Development Code to add Urban Agriculture as a permitted use and establish standards

Background

The City Commission adopted Ordinance 9206 which revised the Development Code and other sections of the City Code per TA-15-00346, the Text Amendment to establish Urban Agriculture as a permitted use. Chapter 18 of the City Code was revised to clarify that crops that are grown as part of an Urban Agriculture use, as defined in the Development Code, are not subject to the provisions of Section 18-304 ‘Weeds to Be Removed’ and the City would bear no responsibility for the cutting or abatement of crops grown as part of an Urban Agriculture use.

These changes were made to Subsection (B) of 18-304. Subsection (C) regarding Natural Landscaping was not included in the Incorporation by Reference Document, which resulted in this section being deleted from the City Code. This ordinance will replace the previously approved language.

Action

Staff recommends the approval of Ordinance No.9269 to correct Section 18-304 of the City Code, by replacing subsection 18-304(C) which was inadvertently omitted with the IBR for Text Amendment TA-15-00346, Urban Agriculture.
