Background
D & S Land, LLC (“Owner”), owns approximately 159.67 acres (“subject property”) located at the southwest corner of North 1500 Road and K-10 Highway. On April 11, 2016, the Owner filed with the City Request for Annexation, No. A-16-00135, seeking to annex the subject property into the City for the purposes of facilitating a future residential development of the subject property.
Since the subject property adjoins the City, the City may, upon the request of the Owner, annex the subject property. See K.S.A. 2015 Supp. 12-520(a)(7).
City policy currently requires all annexation requests involving more than 10 acres to be referred to the Lawrence-Douglas County Metropolitan Planning Commission for recommendation. Accordingly, Planning Staff requests the City Commission to receive the Request for Annexation and to refer it to the Planning Commission for recommendation.
Additionally, before the City may annex the subject property, State law requires the City to give notice to Douglas County Rural Water District No. 1 and to Kaw Valley Electric. See K.S.A. 2015 Supp. 12-539; see also K.S.A. 66-1,176. Accordingly, Planning Staff also requests the City Commission to authorize the City Manager to give the requisite notices.
It must be emphasized that the City Commission is not taking action on the Request for Annexation at this time. City Staff only asks the City Commission to receive the application, to refer it to the Planning Commission for recommendation, and to direct the City Manager to send the statutory notices.
Action
Receive Request for Annexation, No. A-16-00135, refer the Request for Annexation to the Lawrence-Douglas County Metropolitan Planning Commission for recommendation, and authorize the City Manager to give notice to Douglas County Rural Water District No. 1 and Kaw Valley Electric of the City’s intent to annex the subject property.
