945 Missouri Street License Agreement |
Geneva L. Swartzel, Trustee, as owner of 945 Missouri Street, is in the process of redeveloping the existing multi-dwelling structure on that real property and converting it to a detached single-dwelling. The lot has been and continues to be nonconforming. For years, the multi-dwelling structure at 945 Missouri Street used a portion of the City’s Right of Way on West 10th Street for parking. As a condition of issuing the building permit and granting a variance for use of the lot for a detached single-dwelling, and in order to protect the City’s interests in the West 10th Street Right of Way, the City requires the owner of 945 Missouri Street to execute a License Agreement, whereby 945 Missouri will be granted, subject to certain terms conditions, the nonexclusive right – at no charge – to use a portion of the City’s Right of Way on West 10th Street for parking. City Staff and the owner of 945 Missouri Street have reached an agreement on the terms of a License Agreement. Exhibit A to the Agreement shows the parking area.
Action Requested
Authorize the City Manager to execute a License Agreement, permitting the owner of 945 Missouri Street, Geneva L. Swartzel, Trustee, to use a portion of the City’s Right of Way on West 10th Street for parking in accordance with the terms and conditions of that Agreement.
