RE:

Fox Chase South Addition No. 3 – Tract A & C

Project Description:

The developers of Fox Chase South Addition No. 3 continue to build out the undeveloped portions of the subdivision.  Waverly Drive has now been extended past Bowersock Drive.  Pursuant to the platting requirements and notes on the plat, an access point to the adjacent DeVictor Park will be deeded to the City.  The property owners of Tract A, Devco, Inc., and Tract C, Marla, LLC, have requested that the City accept Tract A to be used as an access and utility easement and Tract C as park and open space (see attached plat).  The plat notes also indicate there is a 10 foot building setback from Tract A.  The developers in December, 2013 deeded the Tract B access point to the City.

Upon acceptance of the property, Parks and Recreation personnel will identify and mark the boundaries of the access Tract A and both properties will be removed from the tax rolls.

Action Requested:

Accept dedication of Tract A and C, Fox Chase South Addition No. 3 from Devco, Inc. and Marla, LLC., to the City of Lawrence.
