Kansas Fiber Network Right of Way License Agreement (Addendum no. 3)

 

Background

Pursuant to the City’s Fiber Optics Policy, the City entered a memorandum of understanding with Kansas Fiber Network for the use of City right of way to install and maintain fiber optic facilities. Additionally, KFN leases City-owned dark fiber and has been granted access to certain City rights of way through separate license agreements for the purpose of developing its fiber network and connecting customers.

 

The proposed right of way license agreement would enable KFN to connect additional customers to its fiber network. If approved, the agreement would authorize KFN to install fiber optic facilities and equipment in City right of way around the intersections of 8th and Tennessee, 23rd and Kasold, and Wakarusa and Legends, as described in section three of the agreement. In aggregate, KFN would receive 2,168 feet of right of way in exchange for a one-time payment of $2,000 to the City.            

 

Staff Recommendation

The license agreement enables KFN to connect customers to its fiber optic network in order to provide internet service and establishes equitable compensation to the City. Staff recommends approval of the proposed agreement. 

 

Action

Authorize the Interim City Manager to execute the right of way license agreement with Kansas Fiber Network for the installation of fiber optic facilities.
