License Agreement for the Use of Right-of-Way - 3328 W. 8th Street

 

Project Description

The property at 3328 W. 8th Street is experiencing significant stormwater ponding in the backyard when it rains.  During heavy rainfall events the property, as well as the existing home, are subject to localized flooding and potential damage. Topography prevents the low area in the back yard from draining by gravity and thus the need for a collection sump, pump and corresponding discharge pipe.  Unfortunately efforts to discharge the pipe to the Northeast through the adjoining property have been unsuccessful (see attached map).

 

The license agreement allows the installation of a sump discharge pipe through the right of way on 8th Street. It is important to note that the pipe will only experience flow during and for a short time after a rainfall has concluded. The owner will be responsible for installation and maintenance as well as any relocation or removal costs in the event the City needs to use the right-of-way for the City’s purposes.

 

Action

Authorize the City Manager to execute a License Agreement for the use of Right-of-Way with the property owners of 3328 W. 8th Street, Aaron M. Crim and Heather S. Laskey for the installation of a sump discharge pipe.
