Project History
In April 2004, the city was awarded an Economic Development Grant from the Kansas Department of Transportation (KDOT) for consolidation of access points along 23rd Street, from Iowa to Louisiana. Consolidation of access points improves traffic flow and safety. According to the city-state agreement, KDOT would pay seventy-fiver percent (75%) of actual construction costs up to a maximum of $500,000 while City costs would include engineering, right-of-way, utilities and twenty-five percent (25%) of construction costs.
The original project plan was to consolidate access points at 30 different locations. Due to lack of participation by business/property owners, the original project never moved to the construction phase. Staff has been working to consolidate and reconfigure access driveways whenever opportunities arise, typically during redevelopment. Following are the nine projects completed so far:

Of the original $500,000 grant, approximately $175,000 in state funds remain for future access improvement projects. With the impending removal of the K-10 designation on 23rd Street after the South Lawrence Trafficway is completed, city staff is proactively working to identify other potential projects.
Project Details – Qdoba and T-Mobile
The proposed development plan at Qdoba (former Kwik Shop convenience store) northwest of 23rd & Ousdahl includes the reconfiguration of the access to 23rd Street. Both the existing Qdoba driveway and the T-Mobile driveway on 23rd Street are being removed and reconstructed into one combined driveway. The two adjacent property owners are in support of the project and have executed a cross access easement.
Project Costs / Funding
KDOT has agreed to fund the project up to $80,000 (KDOT participation 75% and City participation of 25%). The property owner will be responsible for costs exceeding $80,000 on the project. A summary of the costs are as follows:

All project costs will be paid upfront by the property owner. After completion of the project, City will reimburse the property owner for actual construction costs up to a maximum amount of $80,000. Under the City/State agreement for the 23rd Street Access Management project, KDOT will then reimburse the City seventy-fiver (75%) of the total amount or $60,000 for the project. The city share, a total of $20,000, will be funded with street maintenance funds.
KDOT City/State Agreements
Attached is supplemental agreement No. 4 for Whole Foods and Party America project that was constructed in 2012. Following execution of this agreement will be forth coming supplemental agreements for reimbursement of other completed access projects and the Qdoba project.
Project Schedule
Site construction activities and reconstruction of the driveways on 23rd Street will begin spring 2016 and is expected to be completed in summer 2016.
Action
Authorize City Manager to execute development agreement for project PW1538 – Access Management Improvements at Qdoba and T-Mobile.
Authorize the Mayor to execute Supplemental Agreement No. 4 with KDOT for reimbursement of state funds for Whole Foods and Party America project.
