RE:	Summer Tree Office, LLC, Right of Way Agreement

Summer Tree Office, L.L.C., owns that real property adjoining West Sixth Street and commonly known as 4205 West Sixth Street. Summer Tree Office, L.L.C., wishes to place a new 6-foot by 8-foot monument business sign in the City's West Sixth Street Right of Way. On January 7, 2016, the Sign Code Board of Appeals approved a variance for the proposed business sign. To place the business sign in the City Right of Way, in order to protect the City's interests in the Right of Way, Summer Tree Office, L.L.C., must first execute a license agreement, whereby it will be granted, subject to certain conditions, the nonexclusive right -- at no charge -- to place the proposed business sign in the West Sixth Street Right of Way. City Staff and Summer Tree Office, L.L.C., have reached an agreement on the terms of a License Agreement.

Action Requested:

Authorize the City Manager to execute a License Agreement permitting Summer Tree Office, L.L.C., to place a business sign in the West Sixth Street Right of Way in accordance with the terms of that Agreement.
