Injury Claim Settlement  

 

In March 2015, Brian Sexton filed a Notice of Claim with the City as a result of a 2014 collision that occurred between Mr. Sexton and a City trash truck. That collision resulted in personal injuries to Mr. Sexton, who sought monetary damages from the City in an amount of just under $75,000.

 

At this time, after thorough review of the case and claim, it is the recommendation of the City Attorney’s Office that the City enter into a settlement with Mr. Sexton in the amount of $18,000, and an agreement to forego collection of a bill from Lawrence Douglas County Fire Medical (LDCFM) in the amount of $586.31. In exchange, the City will receive a release of all claims related to this matter, executed by Mr. Sexton. The matter will be resolved without litigation.

 

Action

Authorize the Interim City Manager to settle Brian Sexton’s claim in the amount of $18,000, and to forego collection of a LDCFM bill in the amount of $586.31.
