Background
The Planning Director administratively approved a Site Plan [SP-8-46-10] for a Construction Sales and Service commercial building at 1516 W. 6th Street (see attached area map) on November 10, 2010 subject to the following conditions of approval:
1. Provision of a site plan performance agreement.
2. Execution of an agreement not to protest the formation of a benefit district for street and sidewalk improvements for Florida and Minnesota Streets.
3. Applicant shall provide a revised site plan that includes the following notes and changes:
a. Show legal description as Whelan's Addition.
b. Provision of a note per Fire/Medical Department approval regarding mechanism for gates for emergency service access.
A revised site plan was provided in 2010 that completed the conditions 3a and 3b. The site plan is attached.
Per Section 1305(o) of the Development Code, if the landowner fails to obtain a building permit within 24 months after final approval of the site plan, then the site plan shall expire unless an extension request showing good cause is provided to the Planning Office prior to the expiration date.
The City Commission approved an extension request in 2012 establishing a new expiration date of November 10, 2014. Staff has continued to communicate with the applicant regarding the status of the project. On October 27, 2014 staff received written communication requesting the extension of the request (attached).
Staff Discussion
The site plan was reviewed under the standards of the 2006 Development Code. The site plan has been approved but the conditions of approval 1 and 2 must be met before the site plan can be released for building permits. The proposed use, Construction Sales and Services, is an appropriate use for the area and the site design maintains compatibility with the surrounding neighborhood.
Staff Recommendation
Planning Staff recommends approval of the 24 month extension of the site plan approval for SP-8-46-10 to November 10, 2016 subject to the condition that the Conditions of Approval noted above shall be met within this time frame.
Action
Approve request to extend approval for Site Plan, SP-8-46-10, for McCray Lumber Company, Construction Sales and Services use, located at 1516 W 6th Street. Submitted by RJ Brown for McCray Lumber, property owner of record to expire on November 10, 2016.
