RE:	Scrap Metal Dealer Registration Amendments

In 2011, the Kansas Legislature passed House Bill 2312.  The bill required all cities to have in place a registration process for scrap metal dealers.  The City Commission adopted Ordinance 8691 which enacted the City’s scrap metal dealer regulations creating Article 18 of Chapter 6 of the City Code.  The City’s regulations mirrored House Bill 2312 as scrap metal dealers are licensed by the State.

The 2012 legislature adopted House Bill 2470.  It made two minor changes to the regulations adopted. 

• The registration renewal fee can range from $25 to $50 which was somewhat unclear in the original legislation.  The City Code has a $50 renewal fee.
• The bill also deletes the requirement that wires, cables, etc. owned by utilities that had the sheathing removed, could not be purchased by scrap metal dealers.

Our local ordinance should be uniform with the State enactment.  Ordinance No. 8734 amends Article 18 of Chapter 6 of the Code of the City of Lawrence to codify these legislative changes.  The ordinance will become effective upon publication.

Action Requested:  Adopt Ordinance No. 8734 enacting revised scrap metal dealer registration requirements.
