RE:                  DLI Business Directory Kiosk

Downtown Lawrence, Inc. ("DLI"), has proposed to locate, in the City's Right of Way downtown on Massachusetts Street, a Business Directory Kiosk that would feature a map and a directory of various downtown businesses. On February 5, 2013, the City Commission approved DLI's proposal and directed staff to negotiate and to prepare a License Agreement that would permit DLI, subject to certain conditions, to locate the Business Directory Kiosk in the City's Right of Way. City staff and DLI have now reached an agreement as to the terms of that agreement. In addition to the general conditions permitting use of a Right of Way, including maintenance, indemnification of the City, and the like, the agreement also requires DLI to permit non-DLI businesses to be included on the Business Directory Kiosk, subject to the payment to DLI of an annual fee of $175.00.

Action Requested: Staff requests the City Commission to authorize the City Manager to execute a License Agreement permitting Downtown Lawrence, Inc., to use a certain portion of the Massachusetts Street Right of Way for the location of a Business Directory Kiosk in accordance with the terms of that agreement.
